Who can buy
Customers 21 and older with valid government-issued photo ID. Maine OCP requires age verification on every adult-use cannabis sale at the point of transaction. Accepted ID forms include any unexpired US driver's license, US passport, US military ID, US passport card, or any state-issued non-driver ID showing date of birth. What's prohibited
Sale to minors (Title 28-B §1501). Resale of Maine-purchased cannabis without a Maine OCP license. Transport of Maine cannabis across state lines, federal law (Controlled Substances Act) and Maine OCP rules both apply. Cannabis consumption in public places, restaurants, parks, sidewalks, public events. Operating a motor vehicle under the influence of cannabis (Title 29-A). Sale to a visibly intoxicated person. Cannabis on federal land, including national parks within Maine (Acadia National Park, the Appalachian Trail federally-managed sections).
Possession and home cultivation
Maine adults 21 and older can possess and may home-cultivate cannabis under Maine OCP-defined limits. Title 28-B sets possession ceilings for usable cannabis, concentrates, and edibles by weight + cannabinoid content. Home cultivation is permitted in Maine for personal use (not for sale). Specific possession and cultivation limits are codified in Title 28-B and revised periodically by the Maine Legislature, consult maine.gov/dafs/ocp for the current statutory caps before planning at-home cultivation or large purchases.
Marketing rules (28-B §702)
Maine cannabis marketing is regulated under 28-B §702 (adult-use) and 22 §2429-B (medical). Misleading, deceptive, or false marketing is prohibited. Advertising specifically designed to target minors is prohibited. Banner advertising on mass-market websites is prohibited. Internet advertising must have an easy and permanent opt-out. Per 18-691 CMR ch. 30, imagery 'commonly associated with under-21 audiences' is banned, cartoons, fruit characters, animals, sports figures, music, social media branding, fictional creatures. Tax and pricing
Maine adult-use cannabis carries a 14% sales tax at retail under 36 M.R.S. §1811, raised from 10% effective January 1, 2026, plus a per-pound cultivation excise tax (36 M.R.S. §4923) paid upstream by cultivation facilities. Retail prices reflect both. Sales to qualifying medical patients are not taxed at the adult-use rate. Delivery
Adult-use cannabis delivery to private residences is authorized statewide under Maine Title 28-B §504, delivery to a private residence cannot be blocked by a municipality, even if that municipality has opted out of adult-use retail sales. Delivery hours: 7:00 AM to 10:00 PM only. Delivery drivers must complete Maine OCP-required age-verification training. Cannabis must be in OCP-compliant sealed packaging during delivery. What changed in 2024
Maine OCP published updated Compliance Rules (18-691 CMR ch. 5, 10, 20, 30, 40) effective November 6 and 12, 2024. Augusta opted in to adult-use retail in summer 2024 (council 5-1 vote, first stores opened October 2024). Camden voters rejected retail in a 2023 referendum.
